Customs duty on Toys and Games

There is no restriction on importing the Toys and Games. A list of goods and with respective duty if some body imports for commercial purpose.

The above sports goods if imported for personal use than the total duty is 17.34%. A doubt is raised that when the some sports goods imported for commercial purpose are attracting lesser duty than the duty meant for goods for personal purpose.Then ,what should be duty to be paid for such personal imported sports goods?.Further these goods are for re-sale purpose than the effective duty after clearance will reduce by 4%.The goods imported for personal use are attracting more duty then the goods meant for personal purpose.This is discriminatory.

thanks for the great info - I would be grateful if you could help me out with a clarification - you metioned a duty of 17.34 % while importing sports equipment for personal use. I am looking to import a sports simulator worth $ 800 to improve my game - will it also attract a duty of 17.34%. Also - who will asses this duty if I am to import it via a courier company - what recourse do I have if the assesing authority interprets it in a different way and asks for a higher duty rate?

Yes sports goods imported through postal attract 17.34% duty.But if you import the sports simulator game through courier then you may pay duty @34.130% and it is your courier comany will interact on your behalf to the customs.
pl check with your courier company about duty.
I have understood that your game is similar to video games.If something else,pl specify in detail.

The current Customs duty on Golf set is 14.712%, irrespective of value of the set.

There is no duty on golf set imported through post and coureir ,if they are bonafide gift, upto Rs 10,000/-.

I collect action figures (=toys) as a hobby. My brother sends me stuff from the USA bought of ebay. So far i have had no problems until yesterday. I went to the sub-foreign customs office at Bangalore to track two of my parcels as I had not received them after two weeks (although they had arrived in India according to the tracking information).

The cost of one of the parcels was $108 ( ~$50 for shipping) and the other was $89 (~$50 for shipping). Initially the officer informed me that as per rules I can purchase items for a maximum of Rs 2000/- and Rs 5000/- if it is sent as a gift. Further he mentioned that these costs were excluding shipping costs. He also mentioned that customs duty is chargeable at 14.7% below Rs 2000/- and 34% otherwise. He also informed me that any self made purchases (not gift) above Rs 2000/- requires an IEC code and can be subject to a penalty of around Rs 5000/-.

He suggested I speak to the Superintendent of Customs (P.A.D). He on the other told that in calculating the duty they consider the total cost (including shipping) and with a duty of 34% i would be required to pay an amount of ~Rs 3500/-. Although the item was a gift he says that most often parcels are marked that way even if is not a gift and so they dont assess it in that manner.

My questions are
1. What is the maximum cost of the item I can buy of the Internet myself (not a gift) and what would be the corresponding duty charges?

2. What is the maximum cost of the item I can receive as a GIFT? Are duties payable to items marked as gift? How can i ascertain to the officers that it is indeed a gift.

3. Are shipping charges included/excluded when calculating the charges?

4. Do I require an IEC number even though the items are for personal use and not commercial.


It would be really helpful if you could answer these questions and also point to any material in a book or the Internet where the rules are clearly stated. I can in future use this in putting forth my case.

Bonafide gifts up to Rs 10,000/- is without duty. NO IEC code for personal import.Consumer electronics goods valuing more than Rs 2000/- is restricted through Post.
Freight charge cannot be more than 25% of the value ,if goods imported through AIR ,and, it is 20% for goods imported through SEA.
All your queries are already answared through various Post and answer session.

2. What happens if the freight charge is more than 25% of the value.

-Most often on ebay you might win a heavy item at a low price which makes the shipping much more then the actual cost!!

For Eg. I will be receiving a gift which costs $70 but the shipping is $120

There is no limit for personal import. To pay customs duty, you can claim duty based on 25% of value as freight charge.Even though you may be paying higher than this.But you should not downgrade value of the goods for sake of evading duty.
Any bonafide claim is based on bonafide value only.

I want to buy LCD TV worth 650$ on ebay in USA. Actual price in US market range from 600$ - 850$.
Indian market price might be 1000$.
If I want to send LCD TV to india. Many questions arise in my mind:

a) If i take TV with myself, will I be charged duty on differential after 500$ allowance and noton invoice price. Which means pay duty on 150$ <= (650$ - 500$)

b) How much the "TOTAL" duty would be 35% or 17%. (for personal use).
which means TOTAL duty of say 35% on 150$.

c) Is it legal for customs officer to not consider invoice price at all(by providing his own interpretation of regulation)? Is there any Copy of customs rule/regulation which I can keep to show him that
he has to consider price I paid and not Indian MRP. what's the point in importing the goods?
which means not paying the duty on 1000$ (indian mrp) - 500$(allowance) = $500

d) What if I take the TV to India from USA after 1 yr of use. Will the depreciation of 16% applies on invoice price I paid?
Hence I pay duty on 50$ <= { 550$(after 16% depreciation cost) - 500$(allowance) }

e) What if I send the LCD tv by postal mail. is it advisable?

Total duty comprising of Basic,Excise,SAD,CESS,NCCD,ANTI DUMPING DUTY.In addition to these, there be more duty on specific goods.

The Total duty mentioned for personal import through post is 17.34%. This is effective duty on goods falling under CTH 9804.If goods are not for personal use and does not fall under heading (CTH) 9804 than the duty may be 31.703%.

But import duty vary for same goods if they are imported by courier or postal,in some cases.For example goods for personal use charged less in Post than courier.

ANY USED GOODS IS IMPORTED THROUGH POST,COURIER ,SEA AND AIR CARGO IS NOT ALLOWED EXCEPT CAPITAL GOODS AS PER EXPORT-IMPORT POLICY.(VISIT DGFT WEBSITE)

Electronics consumer goods valuing Rs 2000/-(CIF) are not allowed to be imported as per IMPORT POLICY AND FOREIGN IMPORT REGULATIONS AND ORDER(VISIT DGFT WEBSITE AND SEE LINK GIVEN IN THIS BLOG ON LEFT HAND SIDE) THROUGH POST BUT NO RESTRICTION THROUGH COURIER.(Read Courier regulation for import and export for more detail)

3)Indian MRP is taken for calculating excise duty. But to calculate duty based on MRP PRICE, there is abatement of 33% on the MRP PRICE.In another words, 67% of indian MRP is taken as value to calculate excise duty.

As per Customs valuation Rule,domestic price are not taken to decide value for determining customs duty.(Pl see Import valuation rule 2007 at cbec website,link is available on this blog)

The custom duty is charged on price paid by buyer to seller provided they are not related to each other.If customs department reject your value than they have to assign reason to this.


There is depreciation for old goods but you have to have patients to claim before authority.

The customs department have value information for all popular models and if you give value evidence,they will take this into account for determining the value and duty.

i try to clear your doubts,subject is slightly technical in nature and open for legal interpretations.

Over the 5 years in US, I have collected 50-60 diecast model cars, trucks,etc. I am shipping it to India via movers and will be in India to get it released at customs. The total value of the model cars may be about $1300 US and many were purchased over 3-4 years ago. Will I be charged any customs duty? If so what percent? Thank You.

If your bringing through baggage than Duty is @ 35 % after permissible limit.

Second /used goods are not allowed to be imported through post ,air cargo and sea,they attract fine and penalty.

But personal effects through Baggage are not treated this way.

If you are bringing through Post :

The Total duty mentioned for personal import through post is 17.34%. This is effective duty on goods falling under CTH 9804. If you send 50-60 cars in one parcel it may be thought that they are not for personal use.

If goods are through courier then duty may be 31.703%.

I have read almost all your blogs and was really impressed with what you are doing. This is the power of IT to create awareness.
I would like to get few clarifications on import through post for personal use.
1. I purchased an unassembeled scale model airplane kit consisting mostly of wodden parts from ebay recently and it was shipped through USPS.
2. I received a notice from PAD and duly went and explained to them what it was and also showed them the correct invoices. I even gave a written declarations stating these were for my personal use.
3. I was asked to obtain an EXIM code and was told that the duty would be charged @ 31% on the article.
4. From your blogs and from DGFT site I am given to understand that no EXIM code is required and a permanent code is allotted for import for personal use.
3. From your blog I am also give to understand that the effective rate of duty for personal imports through post is 17.34%.

Is the PAD office asessing correct duty ? What options I have after clearing my parcel on payment of demanded duty?

If you think that you are charged more duty than before accepting parcel and it get cleared from the Customs, you should meet higher officer and request him through written request to charge proper duty.
If you have paid duty and received goods ,then,it will be time consuming and litigation process.

You have to go Customs.The goods are old and used. The same will be valued by Customs ,may be in your presence.
It is advisable that you hire some authorised Custom House Agent who is expert in handling transfer residece case. He will charge some fee but he will help you. Duty under baggage is 35% after allowance.

Your site is doing a wonderful job and is very helpful for people who doesn't know much about import duty. However I have a query for which I haven't got an answer yet.
I have imported an air purifier from a Chinese company for my personal use. Totally I paid 112 usd (for air purifier)+ 135 usd (for shipping) to the company. In fact the company assured me that I don't need to pay any duty from my end.
Last week I contacted PAD in Bangalore (where I live) regarding the parcel, they told me invoice is not there is parcel and asked for invoice and I gave them.
In fact they told me if value of the item is above Rs.10,000, I have to pay duty. As per the invoice, total charges was 247usd (including shipping). In fact I gave them 2 bills one for air purifier purchase and another for shipping charges.
Today when I contacted the reached the post office in my area, I came to know I had to pay Rs.3265 as import duty.
since the amount I paid (112 usd) for the air purifier is less than 10,000 INR,I thought I don't need to pay any duty.. It looks like they have charged almost 26% of total amount (i.e.,112usd+135usd) as duty.
my query is why are they including shipping charges and then calculating import duty? is it not wrong? should not they only look at the actual value of the item?
Could you please clarify and advice whether I should pay the duty? or go to customs for re-assessment?

I am a national level tennis player and was All India University Champion.. Right now I play tennis as well as train a number of upcoming players.

A friend of mine sent an ems parcel from China as a gift. This parcel contains tennis racquets and its for personal use of mine.

I was tracking the status of the parcel and it was handed over to customs 7 days ago. It was finally released today, without any further updates yet.

You mentioned tennis racquets attract 17% duty. I was reading here

Is this true? If there is any limit attached? I am asking this because I as a tennis player require new racquets and balls from time to time and I was thinking about purchasing them from china since the prices there are really very cheap compared to India. Also what about my current racquets? Although Customs released them today. I am worried that I will have to pay a very high duty when it arrives coz they are not aware that I belong to outstanding sportsperson category.

How can I be exempted from the duty? Whom I need to contact for this? Can I do this over phone/email/fax or will I have to send a letter to the customs department? And how long will the parcel wait here if I refuse to pay the duty until I receive some clarification from customs? I sent lots of emails to mumbai customs but all of them failed to deliever. Also how can I make sure that customs don't charge me anything if I decide to purchase racquets from china in future? Should I ask the supplier to accompany the parcel with some sort of letter explaining that the racquets are being imported under outstanding sportsperson category?

The item does not require any import licence.You have to pay duty @ 14.712% ,if imported through post for personal use.
Further, i am in process of developing website,where one can find,whether one need any licence,how much duty has to be paid, whether importing through courier will be better option compared to Post,etc. Currently , your item is not in database.
You can try 'LCD tv' import and available options for duty savings.

Duty on toys @ 14.712 %. But import of toys are to satisfy various safety requirement as per ISO 8124 ,IS 9873 of BIS.It is advisable that you either visit or contact DGFT office or website for more information. Inport of toys are restricted from some country.

Thanks for referring site www.20north.com.If you know some more interesting site,pl let me know.i have already integrated my site www.ebay.globaltaxgurur.in to ebay and amazon.It is working fine with ebay.you can enter any product ,it will fetch value and shipping cost from ebay then it will ask you other detail to show rate of duty, total duty amount, landing cost,what is duty saving if imported through Post,Courier,Baggage,sea cargo and air cargo.Further duty variability as per purpose such as gift,personal use, commercial use, repair, return.Our Indian tax system is complex and require lot of effort to make it easy to understand for common man.

20north.com has assessed a total duty of about 28% for a electric toy train that I am planning to purchase. The split up is as follows:
Basic duty (toys) 10%
Excise duty- 8%
Customs cess- 3%
Additional Duty-4%
Excise cess-3%
I wanted to ask you if this is the correct calculation.

Video games( playing with tv) are attracting duty @ 26.85%.
But toys are attracting duty @ 14.712 %.
The duty break up is:
Basic duty (toys) 10%
Excise duty- 0%
Customs cess- 3%
Additional Duty-4%
Excise cess-0%.

I would just like to clarify something:
I live in New Zealand, but am wanting to send a toy kitchen set to Gujarat, India (straight from eBay.com) for my 3-year-old niece, which costs US$33 for the toy + US$29 for shipping (being shipped from Hong Kong).
I'm wanting to keep it a surprise, so I need to know if my relatives will have to pay any tax/duty on this, because it wouldn't be such a nice surprise to have to pay for something they never wanted in the first place.

Normally fine is imposed to neutralize, your margin of profit, and penalty to prevent you from violating Law. It is Customs department decide what is fine and penalty, so , i cannot comment on that.

I am going to India to visit my family for sometime since I have just completed my studies in the UK and have not been home since September 2009. I chanced to see your blog and was hoping if you could kindly answer my query. I wish to carry a golf set for my father and I read in your blog that a customs duty of 14.712% is levied on such items if it is not a bonafide gift and above Rs 10,000. I saw the date of your reply to a similar query in the blog to be sometime in 2008. Ever since then, have there been any changes or is it still the same rule.?

Also, I dont have much understanding of these concepts so does a 14.7% duty mean that 14.7% of the price of the item will be payable by me to Customs? Or is this calculated in some other way?

Finally, is there going to be any additional tax on the golf set?

I am running a scale model train store in India, for this purpose i have ordered bulk import from USA (website:www.modeltrainstuff.com)by USPS.
Total order is for $1,108.38 (material cost: $787.88/ shipping cost: $320.50).
How much import duty would be charged by customs on this bulk toy train order as i dont have IEC no. as of now?

And if i register myself for IEC no., would it benefit in reducing the import duty?..

Also give information about the order amount i can place as a "personal gift order" on which no duty would be charged?
