whether digital stiil camera and camcorder are same

As per world customs classification rule,including India,the digital camera and camcorder fall under same sub tariff heading 852580.But both are further sub divided .digital camera tariff 85258010 and camcorder 85258020. Hence they are different from each other.There is also different duty charged under indian customs law.
The digital still camera are considered ITA (Information technology Agreement)goods and NO BASIC CUSTOM DUTY IS CHARGED as per Notification 25/2005-customs.(http://www.cbec.gov.in/customs/cs-act/notifications/notfns-2k5/cs25-2k5.pdf).
However,there is change in sub tariff heading from 852540 to 852580 for digital still camera.

First of all, I must appreciate the loads of information you have provided through your blog. It is really appreciable..

Actually, I was trying find out how much duty I would need to pay to get an digital camera from ebay which costs about 400 USD (Panasonic FZ28) and IS NOT AVAILABLE IN INDIA.

I called PAD (postal appraisal department) Bangalore, 080-25589992, who told I need a clearance certificate from DGFT and then custom will be 14%, else there will be penalty, fine, etc.

Then I contacted DGFT, Mr Antony, 25537214, who said there is nothing called clearance certificate!!!. Either they give license or not and that personal imports do not require license if it is not prohibited in ITC (HS) classification.

Finally, puzzled I checked ITC (HS) Classification of digital camera.

It says import is FREE!!!!

On calling PAD back, they are singing the same song about clearance certificate.

In your post, I found that digital camera's attract duty of 36%.

Could you please clarify this situation. Is the 36% duty you mentioned includes penalty, etc.

Dear Mr.Ravi Gosh,
Thanks for appreciation.The digital camera is consumer electronics goods ,and,if CIF value is more than Rs 2000/- then it is not allowed be imported through PAD.You have to pay fine and penalty,in addition to duty.Hence,PAD person was right in his reply.

If you import same camera through AIR CARGO,SEA and Courier,then ,no fine and penalty.It is freely importable.But you have to pay duty @ 31.703%.(Duty rate may change with the time).Hence DGFT was right in his reply.

If the camera is intended for personal use then it attract duty of 17.34% and you produce specific licence issued in your name by the DGFT.The PAD ,Bangalore ,waes referring this aspect.
You are advised to read my post on simila topics to have more clarity.Many people have similar doubts,which i have answered many times.
It is becoming repititive work for me and no value addition to the blog.
I hope i brought some clarity to you.

THanks a lot Ravindra. You made it quite clear that same stuff can have different duties. For a novice, it seems that the govt has made a mess to extort common man. However, that might be the case from govt's perspective.

Anyway, I'll contact DGFT and try getting the license for personal imports. It seems it will end up cheaper to import if the duty is just 17%.

After that will it go to kolkata foreign post office or delhi. Should i visit the fpo in kolkata? Please advise. This garment is of sentimental value and i would appreciate your comments. It may be that your parcel might be coming through AIR upto Delhi,then inland transportation may be through Rail to Kolkata.
You may ask FPO Kolkata or your neighbourhood post office to know the status of the parcel.

Hi Ravindra,

I have received a gift from my sister in US value 7,500/ - . The PAD Bangalore didn't release it and send a Call Memo stating they need Invoice as proof . I have visited PAD office , submitted the invoice and got confirmation from the Superintendent that it will be cleared and I shall get it latest by 10th Nov . Today is 19th Nov and I still have no news about it . I called PAD 080-25589992 but the person is not giving any positive response.

Is there any way I can track it?
Is there any escalation contact?

I don't understand the reason behind this by PAD

Dear Mr Ruchir,
Pl go through my site www.ebay.globaltaxguru.in for checking various option for importing same item through various mode such as Post, courier, air cargo and sea cargo. There is no change in licencing conditions for importability. However there is change in CVD from 8% to 10% and subsequent to this there is change in overall duty after this budget. i am still uploading data in the site. You can navigate for checking importability. Total duty on these items i will notify later. However, there is no change in gift limit without duty.
